1. Acceptance of Terms

By accessing, browsing, registering for, or otherwise using the Brick Selects website, mobile experiences, forms, quizzes, or related services (collectively, the "Service"), you confirm that you are at least 18 years old, have the legal capacity to enter into a binding contract, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.

2. Description of Service

Brick Selects is a lead-referral and marketing platform that connects prospective real estate buyers and sellers with independent, licensed real estate professionals ("Agents"). We are not a real estate broker, lender, appraiser, attorney, escrow agent, or party to any real estate transaction. We do not list properties for sale, represent buyers or sellers, negotiate transactions, or hold client funds. Any agency, brokerage, listing, representation, or transactional relationship is solely between you and the Agent you choose to engage.

3. Eligibility & User Accounts

The Service is intended for users located in the United States who are 18 years of age or older. If you create an account, you agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us immediately at support@brickselects.com if you suspect any unauthorized use.

4. TCPA Consent, Calls, Texts & Email

By submitting your phone number through any Brick Selects form or quiz, you expressly consent to receive calls, autodialed or pre-recorded calls, SMS/MMS text messages, and emails from Brick Selects and the Agents and partners to whom we refer your inquiry, at the number and email address provided, regarding real estate services. Consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies. You may opt out of texts at any time by replying STOP, and you may unsubscribe from marketing emails using the link in any message. Opting out of marketing communications does not stop transactional or service-related messages required to fulfill your request.

5. No Guarantee of Outcome

Brick Selects does not guarantee that any property will be listed, sold, purchased, leased, financed, or appraised at any particular price or within any particular timeframe. All estimates, valuations, market commentary, and timelines shown on the Service are illustrative only and are not appraisals, offers, or binding commitments. Actual results depend on market conditions, property specifics, Agent performance, and decisions made by you and third parties outside our control.

6. Equal Housing & Fair Housing

Brick Selects supports the principles of the federal Fair Housing Act and applicable state and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, handicap, familial status, national origin, sexual orientation, gender identity, or any other protected class. If you believe you have experienced housing discrimination, you may file a complaint with the U.S. Department of Housing and Urban Development (HUD).

7. User Conduct

You agree not to:

• submit false, misleading, or fraudulent information, or impersonate any person;
• use the Service to harass, defame, or harm any Agent, user, or third party;
• scrape, crawl, reverse engineer, or attempt to gain unauthorized access to the Service or its underlying systems;
• interfere with the operation, security, or integrity of the Service; or
• use the Service in violation of any applicable law, regulation, or third-party right.

8. Intellectual Property

The Service and all content, design, code, text, graphics, logos, trademarks, photographs, and other materials are owned by Brick Selects or its licensors and are protected by U.S. and international intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. All other rights are reserved.

9. User Submissions

You retain ownership of any information, content, or feedback you submit ("Submissions"). You grant Brick Selects a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, store, reproduce, modify, and distribute your Submissions for the purpose of operating and improving the Service, referring you to Agents, and complying with legal obligations. You represent that you have all rights necessary to grant this license.

10. Third-Party Services & Links

The Service may contain links to or integrations with third-party websites, tools, or service providers, including Agents, MLS data sources, mortgage providers, mapping providers, and analytics vendors. We do not control and are not responsible for third-party content, policies, or practices. Your dealings with any third party are solely between you and that third party.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BRICK SELECTS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY INFORMATION OBTAINED THROUGH THE SERVICE WILL BE ACCURATE, COMPLETE, OR RELIABLE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRICK SELECTS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY INTERACTION WITH AN AGENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

13. Indemnification

You agree to defend, indemnify, and hold harmless Brick Selects and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any dispute between you and an Agent or other user.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including suspected violation of these Terms. Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination will survive.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall first be addressed through good-faith informal negotiation. If unresolved within thirty (30) days, the dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual action in small-claims court. YOU AND BRICK SELECTS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Material changes will be communicated through the Service or by email when reasonable. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

17. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Brick Selects regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them freely.
